1. Agreement to Terms

By accessing or using NeuroBase Pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

3. Description of Service

NeuroBase Pro is a professional brand and marketing analysis framework, developed by an experienced design and advertising agency. It combines proven neuromarketing principles, behavioral psychology, and strategic brand methodology to deliver actionable insights.

Brand Analysis:

• Brand archetype identification based on established psychological models
• Design system recommendations (colors, typography, imagery)
• Marketing strategy frameworks (StoryBrand, Reward Triggers)
• Comprehensive brand analysis reports

Campaign Analysis:

• Neuroscience-based campaign strategy development
• Emotional trigger mapping and limbic profiling
• Messaging frameworks with channel-specific recommendations
• Tonality guides and behavioral hook strategies

4. User Accounts

4.1 Account Creation

To use the Service, you must:
• Be at least 16 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to:
• Share your account credentials
• Use another user's account
• Create multiple accounts to circumvent limits
• Use automated means to access the Service without permission

5. Pricing Plans

5.1 Single Analysis (€79 one-time)

• One complete brand analysis
• All base features included
• No recurring payments
• Analysis results stored permanently

5.2 Pro Plan (€899 one-time)

• One-time payment of €899
• 5 brand analyses included
• 1 campaign concept included
• All Pro features (Advanced imagery guide, Brand voice guide, Neural triggers)
• Priority support
• No recurring payments

5.3 Campaign Analysis (€59 one-time)

• One complete campaign analysis
• All campaign features included
• No recurring payments
• Analysis results stored permanently
• Pro users: 1 campaign concept included, additional concepts at €59 each

6. Payment Terms

6.1 Billing

• Single Analysis: One-time payment of €79, no recurring charges
• Campaign Analysis: One-time payment of €59, no recurring charges. Pro users get 1 concept included.
• Pro Plan: One-time payment of €899
• Payments are processed via Stripe
• All prices are in Euros (€) and exclude VAT (where applicable)
• VAT will be added for EU customers based on location

6.2 Automatic Renewal (Pro Plan)

The Pro Plan automatically renews each month unless canceled. You will be charged on the same day each month. Cancellation is only possible after the 3-month minimum commitment period.

6.3 Cancellation

• Single Analysis: No cancellation needed (one-time purchase)
• Pro Plan: Cancellation possible after 3-month minimum term with 1-month notice. To cancel, email support@neurobase.design. Cancellation takes effect at the end of the notice period. No refunds are provided for partial months or the remaining minimum term.

6.4 Refund Policy

No refunds are provided. Since the Service delivers immediate value upon payment (instant access to analysis tools and results), refunds are not offered. By purchasing, you acknowledge that:
• You receive immediate access to all paid features
• Analysis results are generated and delivered instantly
• The Service is immediately consumable upon payment

Exceptions only in case of:
• Technical errors preventing service access for more than 48 hours
• As required by law (e.g., mandatory EU consumer protection in specific cases)

7. Acceptable Use

You agree not to:
• Use the Service for illegal purposes
• Reverse engineer or attempt to extract the underlying analytical frameworks
• Scrape or automatically collect data from the Service
• Upload malicious code or attempt to compromise security
• Resell or redistribute the Service without permission
• Use the Service to generate content that violates third-party rights
• Abuse rate limits or attempt denial-of-service attacks

8. Intellectual Property

8.1 Your Content

You retain ownership of all brand data you input. By using the Service, you grant us a license to process your data solely to provide the Service.

8.2 Our Content

The Service, including all software, algorithms, designs, and documentation, is owned by FORMM Media & Marketing and protected by copyright, trademark, and other laws.

8.3 Analysis Results

Analysis results generated by the Service are provided to you for your use. You may use them for your business purposes, but you may not resell the raw analysis reports as a standalone product.

9. Disclaimers

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee that:
• The Service will be uninterrupted or error-free
• Analysis results will be accurate or suitable for your specific needs
• Defects will be corrected

9.2 Analysis Results & Methodology

Analysis results are generated using proprietary analytical frameworks developed from established neuromarketing and behavioral psychology research. Results should be used as strategic guidance and professional recommendations. We recommend adaptation of all results to your specific business context and market conditions.

10. Limitation of Liability

To the maximum extent permitted by law, FORMM Media & Marketing shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use of analysis-based recommendations

Our total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you:
• Violate these Terms
• Engage in fraudulent activity
• Use the Service in a manner that harms us or other users

Upon termination, your right to use the Service ceases immediately. You may request a data export within 30 days of termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law & Jurisdiction

These Terms are governed by German law. Any disputes shall be resolved in the courts of Berlin, Germany.

EU consumers have the right to bring proceedings in their country of residence.
